- “Data Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Data.
- “Data Processor” means a natural or legal person, public authority, agency or other body which Processes Personal Data on behalf of the Data Controller.
- “GDPR” means Regulation EU 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data.
- “Personal Data” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, an address, location data, an e-mail address, a telephone number, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
- “Process” or “Processing” means any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
- “WCD” refers to we connect data BV, a company under Belgian law, established at Sint-Amandsstraat 86, 1853 Grimbergen registered under company number 0650.599.388.
- “Portal” refers to the services WCD offers in the Platform hosted on the domains www.datascouts.eu and www.datascouts.ai.
- “Platform” refers to the digital solution hosted on www.datascouts.eu or www.datascouts.ai to map and activate ecosystems, enable stakeholder engagement, gather market and trend insights, and facilitate collective intelligence, containing information on actors and their relationships which is controlled by a Customer of WCD.
- “Customer” refers to a customer of WCD who uses a specific Platform to visualise and analyse their market. Customer is Data Controller for the Platform.
- “User(s)” refers to all people logging into the Platform by using the login credentials. User is a Data Controller for his or her Personal Data.
- “User Profile” refers to the password protected part of the Platform where the User can claim (i.e. take control of) an actor profile, rectify or delete the actor profile including but not limited to Personal Data, relations between actors etc.
ATTENTION
Please read these Terms of Use carefully before using this Website and/or a Platform. In order to access the Platform as a User, the User explicitly acknowledges having read, understood by actively accepting them at registration.
WCD may change these Terms of Use from time to time. If the User objects to such a change, the only option is to stop using the Platform. User’s continued use of the Platform implies the acceptance of the changes.
Personal data
Some services on the Platform require the collection of Personal Data.
WCD qualifies as a Data Controller with regard to the Platform : WCD manages the login credentials for the user profiles of the users of the Platform.
In cooperation with its Customer, WCD provides the Platform to the Users. WCD and Customer act as independent Data Controllers as the purposes for the processing of Personal Data differ.
When sharing Personal Data on the Platform, the User, who acts as Data Controller, explicitly allows WCD to store and process the Personal Data for the purpose of creating login credentials for the User Profile on the Platform. WCD acts as an independent Data Controller when Processing these login credentials is based on article 6.1 (b) GDPR, as the Processing is necessary for the provision of the services to the User through the Platform. Should a User refuse to provide certain essential data, WCD reserves the right to refrain from dealing with the User’s question or request.
WCD processes the Personal Data for its own purposes in order to develop, research, process, safeguard, modify and improve its Website and services, and to customise the information provided to the User on its Website based on its legitimate interest.
Customer processes Personal Data of Users in order to manage the Platform by curating and maintaining stakeholder related content, facilitating collaboration among users, and overseeing communications and administrative processes (including user onboarding and invoicing) in line with its own objectives.
WCD qualifies as a Data Processor with regard to the Platform. WCD acts as a Data Processor when it processes Personal Data solely to achieve the specific purpose of the Customer (of WCD) qualifying as a Data Controller through its Website and Platform. The Customer will manage the login credentials of the Users. Customer, as a Data Controller, and WCD entered into a data processing agreement pursuant to art. 28.3 of the GDPR.
The Customer and/or User acting as a Data Controller shall have a legal basis according to Article 6.1 of the GDPR through the Platform and the Website and shall inform the data subjects about the Processing of their Personal Data through the Platform by the means of a privacy policy. The Personal Data collected are not Processed by WCD for its own purposes unless explicitly and priorly agreed upon by the User through an opt-in scenario.
Personal Data are only shared on a need-to-know basis with WCD’s staff who are responsible for achieving the purpose and who shall be bound by an appropriate confidentiality obligation.
WCD Processes the Personal Data through the Platform for the duration of the commercial agreement with its Customer and which is strictly necessary in order to attain the specific Purposes in view of which the data are Processed. Once the Purpose is attained, or on specific request by the User, WCD will delete the Personal Data of the User associated with the Purpose.
In as far as the conditions of the applicable legislation are met, Users whose data are Processed are entitled to:
access their Personal Data and obtain a copy of their Personal Data, and as the case may be, rectify them;
- object to Processing on grounds relating to their particular situation;
- obtain the erasure of such Personal Data or the restriction of Processing;
- receive the Personal Data concerning them in a structured, commonly used and machine-readable format, and to transmit those data to another Data Controller;
- lodge a complaint with the Gegevensbeschermingsautoriteit/Autorité de protection des données if they consider that the agreed Processing of their Personal Data infringes the applicable legislation.
The Users may exercise the rights mentioned under points (1) to (4) with regard to:
- Personal Data Processed by WCD for the Purpose of creating the User Profile on the Platform by means of a dated and signed request to WCD’s Data Protection Officer, Mr. Jan Vansteenlandt sent by e-mail to [email protected], or sent by post to WCD.
- For Personal Data Processed on the Platform itself by means of
a. Claiming the actor profile through the User Profile
b. Taking action on the User Profile (update/rectify/delete)
c. Get in touch with the Customer controlling the Platform through the Platform contact function

Browsing Data
Servers automatically store data sent by a User’s browser each time the Website is consulted. These server log files may contain the following information: the date and time of the visit, the User’s IP address, the type of browser used by the User, the browser language and the browser screen size, and one or more cookies by which the browser can be identified. This information is not linked to Personal Data collected elsewhere and is used solely to record website visitor statistics required for the purpose of assessing and improving the Website.
Third-Party Services

Our Website and services may also implement hyperlinks to the websites of third parties. If you click on such links, you are choosing to visit such websites, and will be redirected thereto. If you click on a third-party link, WCD’s Privacy Policy and Terms of Use are no longer applicable and your browsing is at your own risk.
WCD is not responsible for the privacy and Personal Data practices used by such third parties (including any tools, cookies, information or content contained thereinto), and we do not have control over the manner in which such third parties may collect, Process, treat or use your Personal Data.
You are strongly advised to check the privacy settings, policies and/or notices applicable to such third-party sites and services prior to browsing or using such third-party websites and/or services.
Financial data and information
We use third-party payment processing platforms. These platforms will request you to disclose them sensitive Personal Data (e.g., credit card number, account username and password) in order to complete purchases and operations related to our services.
Such third-party payment processing platforms are governed by their own safety standards, policies and terms of use. We shall not be liable for their operation, safety or otherwise their functioning. We strongly advise our users to engage in online safety measures in order to protect their financial information, here and elsewhere. We will not collect or store any sensitive financial data of you.
Prohibited Uses
Users agree not to use the Website and the Platform:
- in an illegal manenr;
- to stalk, harass or harm;
- to impersonate any other person or entity;
- to misrepresent User’s relation with a person or entity
Further, Users agree not to use any data mining, robots, or similar methods for data collection or extraction.
Prohibited Uses
The laws of Belgium (without regard to its conflict of laws provisions) shall govern these Terms of Use (and any other agreement with WCD). The parties shall first try to settle any dispute between them amicably and in good faith negotiations, within a thirty-day period. If no settlement can be reached within that time period, any dispute with respect to the validity, interpretation or execution of the Terms of Use will be finally settled by the competent courts of Brussels, Belgium, except if mandatory law provisions state otherwise.
